Requests for priority examination pursuant to Rule 41

   The Chamber or its President may give priority to a particular application in accordance with Rule 41. The Court receives several hundreds of requests for priority examination every year. Most of them are not satisfied. Therefore an applicant should have forcible arguments when making a request for an urgent procedure. According to the indicated Rule, there is a possibility of examining an application on a priority basis taking into account particular circumstances of the applicant or the character of the application itself.

   Thus, there is a possibility of speeding up the examination concerning other cases. A profound analysis on priority cases when a complaint contains some important legal issues may take place too. In such a case the lodged complaint should reflect a number of problems which are of great importance for the law-enforcement system, the legislation, and for the ensuring of fundamental human rights and freedoms. As a rule, an inefficient investigation is conducted on a national level in such situations, as a result of which guilty persons are not established and not brought to justice, which gives rise to the atmosphere of impunity. Documents conforming the existence of such circumstances should be attached to the request for priority examination. In practice the decision to give priority to a particular application is also rendered in the cases when the applicant is not able to wait for the examination by ordinary order in connection with his (her) age or the state of health, or where the applicant is alleged to be facing an imminent threat of physical harm.
